Client Responsibilities Under the Promotion of Access to Information Act (PAIA), Act 2 of 2000 (as amended)

As part of our ongoing commitment to legal compliance and good governance, we would like to draw your attention to your responsibilities under the Promotion of Access to Information Act (PAIA), Act 2 of 2000, as amended. This legislation is a cornerstone of South Africa’s democratic framework, ensuring transparency and accountability in both public and private sectors.

Key Responsibilities for Private Bodies:

1.Preparation and Submission of a PAIA Manual

  • Compile a PAIA Manual that includes your organisation’s structure, record types, access procedures, and contact details of the Information Officer.
  • Make the manual available on your website and at your principal place of business.

2.Appointment of an Information Officer

  • Designate an Information Officer (typically the head of the organisation) and register them with the Information Regulator.
  • Deputy Information Officers may also be appointed and must be registered.

3.Processing of Information Requests

  • Respond to access to information requests within 30 calendar days.
  • Provide access unless a valid ground for refusal exists.

4.Record-Keeping and Transparency

  • Maintain accurate and up-to-date records.
  • Ensure the PAIA Manual reflects any changes in operations or structure.

Reporting Requirements Under PAIA:

PAIA stipulates once-off and recurring requirements.

Recurring Requirements

  • Annual review and update of the PAIA Manual.
  • Ongoing processing of information requests.
  • Regular training for Information Officers and deputies (recommended).
  • PAIA Annual Report Submission: Submit an annual report to the Information Regulator between 1 April and 30 June each year, detailing access to information requests and compliance efforts.

Once-Off Requirements

  • Initial compilation and publication of the PAIA Manual.
  • Appointment and registration of the Information Officer and any deputies.

PAIA Annual Report Submission Requirements:

All public and private bodies are required to submit their PAIA Annual Reports to the Information Regulator between 1 April and 30 June. The report must be submitted via the BizPortal platform.

1.Responsible Parties

  • Information Officers (IOs), Heads of Private Bodies (HPBs), and Deputy Information Officers (DIOs).

2.Contents of the Report

  • Number and nature of access to information requests received.
  • How requests were processed and outcomes.
  • Any refusals and reasons for refusal.
  • Challenges encountered in processing requests.

3.Submission Platform

  • Reports must be submitted through the BizPortal platform (https://inforegulator.bizportal.gov.za/).

4.Consequences of Non-Compliance

  • Failure to submit the report or maintain a PAIA Manual may result in penalties, investigations, and reputational damage.
  • Non-compliance may also affect your POPIA compliance status.
